Terms Of Service

By using the App ("Hill Chart", "we", "our", or "us"), you are agreeing to be bound by the following Terms of Service. If you do not agree to these Terms, do not use the App.

The App is operated by Curious Lab Group, which is a trading name of Gani Software Pty Ltd, an Australian registered company (ACN 145 036 577).

You can reach us for support through our support portal.

We are constantly iterating on our service, so these Terms may change over time. If the changes are significant, we will let you know via email or within the app.

Account terms

You must be a human. Accounts registered by "bots" or other automated methods are not permitted.

You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this obligation.

You are responsible for all content posted and activity that occurs under your account.

Use restrictions

You agree not to use the App for any purpose that is unlawful or prohibited by these Terms. You must not:

  • Use the App in a way that violates any laws or regulations.
  • Use the App in a way that violates any rights of Curious Lab Group or its users.
  • Interfere with or disrupt the integrity or performance of the App.
  • Abuse, harass, threaten, or impersonate other users.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, underlying ideas, algorithms, or structure of the App or any of its features, functionalities, or components.

Payment, refunds, and plan changes

If you subscribe to a paid plan, you will be billed in advance on a recurring basis (monthly or annually).

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

If, for any reason, you are not completely satisfied within the first 30 days of your initial paid subscription, just let us know. We will give you a full refund, no questions asked. To claim your refund within this period, reach out to Paddle.com.

Beyond the initial 30-day guarantee period, our fees are generally non-refundable. However, we understand that things can change, or unexpected issues might arise. If you have a refund request after the 30-day period, please reach out to us directly through our support portal. We evaluate these requests on a case-by-case basis.

If you upgrade or downgrade your plan, the new rate will take effect immediately or at the start of your next billing cycle. Downgrading may cause loss of content or features. We do not accept liability for such loss.

Cancellation and termination

You are solely responsible for properly canceling your account. An email or in-app message is not considered cancellation.

You can cancel your account at any time by going to your account settings.

If you cancel your subscription part-way through a billing period, you will still have access until the end of that period, and no refund will be issued for the unused portion.

If you cancel, your content will be deleted from our servers within the time frame specified in our Privacy Policy.

We reserve the right to suspend or terminate accounts for violations of these Terms at our sole discretion.

Modifications to the service and prices

We reserve the right to modify or discontinue the service (or any part of it) at any time with or without notice.

Complaints and feedback

The best way to let us know about your concern is through our dedicated support portal.

Once you submit your complaint, we will aim to acknowledge it within 1-2 business days. Our goal is to provide you with a resolution or a clear update on our progress within 10-15 business days.

For Australian customers, if you believe you have a claim under your consumer rights and we cannot resolve it directly with you, you have the option to contact your relevant State or Territory Fair Trading or Consumer Affairs body.

Uptime, security, and privacy

We strive to maintain 99.9% uptime and take security seriously, including encryption and backups.

Copyright and content ownership

You retain ownership of all content you post to the App. We do not claim any intellectual property rights over the material you provide.

Features and beta access

We may offer new beta features. While we strive to ensure beta features work as intended, they may not be fully stable. These may be experimental and may change or be discontinued without notice.

Fair use & abuse prevention

We reserve the right to limit or prevent abuse of the App. This includes but is not limited to:

  • Attempting to bypass usage limits or paid access.
  • Spamming or flooding the App.
  • Attempting to disrupt the App's operation or degrade its performance.

Liability limitation

You expressly understand and agree that we shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid us in the past 12 months.

If you are an Australian consumer, these terms do not limit any rights you may have under the Australian Consumer Law.
